Indiana County Van Rollover Kills One, Another Critically Injured

Recently, a woman died in a car crash in Burrell Township, Indiana County in Pennsylvania, reports The Pittsburgh Post-Gazette.

According to the article, the woman was a front seat passenger in a minivan that was traveling on Route 22. Around 2 p.m., for unknown reasons, the van crossed the roadway’s median and then went down a steep embankment, rolling until it came to a stop at the bottom of the ravine. The woman, who was not wearing a seat belt, was ejected from the vehicle and was pronounced dead at the scene of the Pennsylvania car crash. The driver of the van, a male, is listed in critical condition at a local hospital. He also was not wearing a safety restraint.

The couple’s two children were also occupants in the van but were uninjured in the rollover accident. They were in child safety seats.

According to a recent report released by the Centers for Disease Control and Prevention (CDC), the average for seat belt use in the U.S. is at an all-time high at 85 percent. However, about one in seven adults report they do not wear a safety restraint during every trip. Motor vehicle accidents are the leading cause of death in the U.S. among those aged five to 34-years-old, but using seat belts has greatly reduced injuries and fatalities, reports the CDC. Using a seat belt reduces the risk of a fatal injury by approximately 45 percent. Using data from the National Highway Traffic Safety Administration (NHTSA), the CDC says that if all states had stringent seat belt enforcement laws, in 2009, close to 450 lives would have been saved and 12,000 injuries prevented.

In Pennsylvania, seat belt use is required for those aged eight through 17-years-old in all seats in a motor vehicle, and those aged eighteen and older in the front seat are required to wear a restraint. The fine is $10 for the first offense of the state seat belt law.

At Cherry Fieger & Marciano, LLP our Pennsylvania rollover accident lawyers have successfully aided those injured in rollover crashes throughout the state obtain the compensation they deserve for their injuries and related losses. To learn how we can help you today, call 1-888-684-7192.

Pennsylvania DOT Names Pittsburgh’s Most Dangerous Roads

The Pennsylvania Department of Transportation and news station WPXI recently released a report on the most dangerous roads and intersections in the Pittsburgh area. The roads named in the report were chosen for the high number of car crashes that take place at these locations.

According to WPXI, the number-one location for dangerous crashes in Allegheny County is Route 51, or Saw Mill Run Boulevard, in Pittsburgh. Meanwhile, in Westmoreland County, the intersection of Route 66 and Beaver Run Road has seen 93 car crashes and three deaths in the last five years. The intersection is in a blind spot, making it invisible to drivers until they have come over the hill. Route 30, which runs between Colonial Manor Apartments and Malts Lane, saw 156 car accidents in the same five-year period.

Other area counties also sport dangerous intersections and stretches of road where Pennsylvania car accidents are common. For example, Route 40 near Uniontown in Fayette County had 32 car accidents in 2010, while Route 21 saw 42 accidents. By far the most dangerous stretch of road, however, was Route 119 outside Connellsville, where there were 87 collisions in 2010.

The Pennsylvania Department of Transportation has begun making plans to make these intersections and stretches of road safer for motorists. However, not even the best transportation planning can prevent every accident. New PA Legislation Proposed to Ban Behind the Wheel Cell Phone Use

The Delaware County Times reports that Senator Andrew E. Dinniman (Chester and Montgomery counties) plans to introduce a bill on March 4 in the Senate to address distracted driving. According to the article, the bill would ban hand-held cell phones and texting while driving, and would only allow hands-free cell phone use only for adult drivers age 18 and older.

The U.S. Department of Transportation describes distracted driving as any non-driving activity that has the potential to distract a person from the primary task of driving and increase the risk of crashing. The three main types of distraction are visual, manual, and cognitive. Texting is the most alarming because it involves all three types of distraction, since it causes a driver to take their eyes away from the road, their hands off of the steering wheel, and their mind off of what they’re doing.

Many states have added laws prohibiting the use of cell phones without hands-free devices. Distracted driving has become a large issue in the U.S. and states are constantly adding some form of cell phone talking or texting ban to make cell phone usage while driving a motor vehicle illegal.

Distracted driving is illegal and any activity that decreases your ability to safely operate a motor vehicle is against the law. If you or someone you love has been in a serious car accident and you believe it was caused by the other driver who was distracted by using their cell phone to text or place a phone call, you may be entitled for compensation for your losses. 1 Killed, 11 Injured in Four-Vehicle Car Crash in Burlco

A woman was killed and 11 people, including several children and one pedestrian, were injured in a multi-vehicle accident on February 21 in Burlco in South Jersey. According to Philly.com, four vehicles were involved in the accident, which occurred when an SUV rear-ended a Mercedes-Benz, pushing it into a bus stop. The car struck a person waiting for the bus and then hit a light pole. The SUV struck at least one other vehicle before it flipped onto its roof.

The article does not say what caused the SUV to rear-end the Mercedes. Multi-vehicle car accidents involve two or more vehicles and often cause severe injuries, fatalities, and extensive vehicle and property damage. Because of the number of vehicles involved, these types of car crashes can be very deadly.

An innocent pedestrian was injured in this multiple vehicle crash. Pedestrian deaths accounted for 10.8 percent of all traffic accident-related deaths in Pennsylvania in 2009. More than 70 percent of pedestrian deaths and 46 percent of pedestrian injuries occurred in areas other than intersections.

Distracted driving can lead to multivehicle crashes. The National Highway Traffic Safety Administration (NHTSA) reported that distracted driving was the reason for 6,000 fatalities and over half a million injuries in 2008, making it a leading cause of auto accidents.

Distracted driving is illegal and any activity that decreases your ability to safely operate a motor vehicle is against the law. If you or someone you love has been in a serious car accident in Pennsylvania and you believe it was caused by a distracted or reckless driver, contact the experienced Pennsylvania car accident lawyers at Cherry Fieger & Marciano, LLP today for a consultation. It is important to hire an experienced attorney who can prove that the driver was significantly distracted in order for you to obtain the compensation you deserve for your injuries and related losses.

Fatal Chester County, PA Car Crash Caused by Excessive Speeding

One teen was driving and another was killed on February 19 in Chester County, PA. According to Philly.com, a 17-year-old was driving a pickup truck and drove into oncoming traffic, striking a 19-year-old woman driving a BMW. According to police, excessive speeding by the pickup truck driver was likely a factor in the fatal accident.

According to the Centers for Disease Control and Prevention (CDC), car crashes are the leading cause of death for teens in the U.S., and account for more than one in three deaths in this age group. In 2009, eight teens ages 16 to 19 died every day from injuries sustained in car accidents. Teen drivers ages 16 to 19 are four times more likely than older drivers to crash.

In Pennsylvania, there were 29,091 drivers ages 16 to 20 who were involved in crashes in 2009. There were about 32, 669 speed-related crashes, with 538 fatalities. Speeding is a contributing factor in over 30 percent of fatal traffic accidents in the U.S.

Legislators have attempted to decrease the number of teen driving deaths by having DUI checkpoints, texting and cell phone legislation, limiting the number of teenagers allowed to ride in the car with a young driver, and more.

If your loved one was recently injured or killed in a car crash in Pennsylvania, you have the right to seek damages from reckless motorists on behalf of lost loved ones. It is in your best interest to retain the services of an experienced attorney who will examine all circumstances surrounding the accident to determine whether the other driver acted negligently or if there were other factors in the crash. Pennsylvania Bill Seeks to Limit Distractions for Teen Drivers

According to a recent article in The Pottstown Mercury, Pennsylvania House Bill 330 contains a number of provisions designed to keep roads safer by eliminating distractions among the state’s least experienced drivers—teens.

If passed, the bill would first cut down on distractions inside the vehicle by limiting 16- and 17-year-old drivers to one passenger under the age of 18, unless the younger passengers are members of the driver’s family. The bill proposes to name this new law “Lacey’s Law” after Lacey Gallagher, a Pennsylvania teen who lost her life in a van accident in 2007. The van was carrying six teen passengers.

House Bill 330 also changes Pennsylvania’s driver education rules. The proposed law would add 15 hours to the 50 hours Pennsylvania teens must drive before earning a driver’s license. Ten of the additional hours must involve nighttime driving, and five must involve driving in bad weather, such as rain or snow.

The bill would also change the rules for using cell phones or other wireless devices on the road. Teenagers would be prohibited from using any wireless device while driving, unless they are contacting someone for help in an emergency. Adults will also be prohibited from using wireless devices while driving. However, the bill allows adults to use hands-free headsets to talk on cell phones, but prohibits teens from using the devices when behind the wheel.

Distracted driving is a major source of serious car accidents, especially among inexperienced drivers. A moment’s distraction on the road can lead to serious injury or even death. If you have been injured in a crash caused by a distracted driver, you need the help of an experienced Pennsylvania accident lawyer. The attorneys at Cherry Fieger & Marciano, LLP have the experience to fight for the compensation you deserve. To schedule a free consultation, call 888-684-7192 today.

In Accidents with Teen Drivers, Victims Frequently Outside of Vehicle

A recent study on teen driving reported that 681,000 people were involved in accidents in 2008 where a teenager was driving. An article in The Times Herald states that the study showed that over 40,000 people were injured and nearly 30 percent of those who died in the crashes were cyclists, pedestrians, or occupants of other vehicles.

In Pennsylvania in 2009, 41 percent of single vehicle crashes involved teen drivers. Additionally, 27 percent of the driver deaths in the 16-20 age range were drunk drivers. In the U.S., 90 percent of all car crashes involve driver error, which means there are many ways teens can impact safety. Failure to use seat belts, speeding, drinking and driving, and distracted driving all contribute to car accidents and fatalities. Overall, car crashes are the number one killer of teenagers, according to Teen Driver Source.

The Centers for Disease Control and Prevention (CDC) recommend that parents practice driving as often as they can with their teen. They should also ensure that their new driver and their passengers always wear seat belts to help prevent injuries and fatalities in Pennsylvania car accidents. Crashes are likely to occur at night and when other teens are in the car, so it is a good idea to limit a teen’s nighttime driving.

Distracted driving is illegal and any activity which substantially decreases a person’s ability to safely operate a motor vehicle is against the law. If you or someone you love has been in a serious car accident in Pennsylvania and you believe it was caused by an inexperienced driver and/or one who was driving distracted, such as using their cell phone or distracted by other passengers in the car, you may be entitled for compensation for your losses. An experienced personal injury lawyer can prove that a negligent driver was significantly distracted and caused an accident.

PA Receives Failing Grade in Highway Safety

A recent article in The Philadelphia Inquirer reported that Pennsylvania received a failing grade from the Advocates for Highway and Auto Safety in regards to highway safety. According to the annual report, PA has a significant lack of safety laws regarding seat belt use, cell phone use, and teen drivers. Among other recommendations, the report urged that Pennsylvania prohibit the use of cell phones and text messaging by beginning drivers. It also recommended limiting the number of passengers for teen drivers.

Because of their inexperience behind the wheel, drivers between the ages of 16 and 21 can be prone to speeding or reckless driving, often due to peer pressure. In Pennsylvania in 2009, 27 percent of the driver deaths in the 16-20 age group were drunk drivers, an increase of 22 percent from 2008.

The AAA Foundation for Traffic Safety reports that talking on a cell phone increases risk of being in a car crash by about 30 percent, and that drivers text messaging are 8 times more likely to be involved in an accident. In Pennsylvania in 2009, 57 people were killed in crashes caused by a distracted driver.

If you or someone you love has been in a serious car accident in Pennsylvania and you believe it was caused by a driver who distracted, such as using their cell phone to text or call someone, you may be entitled to compensation for your losses. Distracted driving is illegal and any activity that substantially decreases your ability to safely operate a motor vehicle is against the law. The Pennsylvania car accident attorneys at Cherry Fieger & Marciano, LLP will investigate your accident and can help you prove that the driver was distracted so you can receive the full and just compensation you deserve. Pennsylvania Residents Suffer Death, Injury in I-79 Accident

A Pennsylvania man lost his life and a woman suffered critical injuries recently when their minivan collided with another van on I-79 near Clarksburg, West Virginia, according to a recent article in the Charleston, West Virginia Gazette.

The Oil City, Pennsylvania couple were driving south on I-79 when their van swerved suddenly, crossing the median and driving into the northbound lane. A pickup truck traveling north hit the van on its passenger side, pushing it into an embankment on the side of the road, according to the West Virginia State Police.

State police and other rescue workers were unable to save the husband, who died at the scene. His wife was taken to the Ruby Memorial Hospital in Morgantown, where she is being treated for critical injuries. The driver of the pickup truck suffered minor injuries. Police have decided he was not responsible for the accident.

The state police are still investigating the accident. They are unsure what happened, but speculated that the man, who was driving, suffered a heart attack or stroke. The minivan was also carrying heavy cargo items like golf clubs, which may have shifted, causing the van to swerve. The state police force’s accident reconstruction team continues to work on the accident.

PA Driver Crashes into House, Causes Explosion and Fire

On January 8, a PA driver crashed his car into a New Jersey home, severing a natural gas line and causing an explosion and fire. An article on MyCentralJersey.com states that one resident was injured and a house was also destroyed in the accident. The fire damaged four other homes, displacing one family.

According to the article, the driver was impaired at the time of the crash. He is now facing serious criminal charges, including driving while under the influence. Because of his serious disregard for the law, he could also be held civilly liable for the injuries caused as well as all the damage to the property. It is going to be extremely costly for the families whose homes were damaged, not to mention how disruptive to their lives it will be to be displaced.

When a driver fails to adhere to traffic laws and safe driving practices, they are ultimately responsible for any injuries that result from accidents their negligence has caused. Driving under the influence continues to be a serious problem in the U.S. In 2008, there were 34,000 auto accident fatalities and 11,773 alcohol-related. Thirty-four percent of all auto accidents in Pennsylvania that year were alcohol-related.

Anyone who is found to be responsible for causing injuries, damage, or death in an auto accident in Pennsylvania can be held liable for having done so in court. Accident victims have the right to seek damages from reckless motorists. It is recommended that they find an experienced Philadelphia auto accident attorney who will examine all circumstances surrounding the crash. Increase in PA Driving Fatalities over New Year’s Holiday

The Pennsylvania State police reported that the number of driving fatalities this year during the New Year’s holiday weekend nearly doubled since last year. An article in The Philadelphia Inquirer said that eleven people were killed and 220 others were injured in the 693 car crashes during the four-day period. Seventy-six of the car accidents were alcohol-related.

According to The National Highway and Traffic Safety Administration, in recent years, the number of fatalities involving an impaired driver during New Year’s is 60 percent higher than the rest of the month. Over New Year’s between 2001 and 2005, there were about 54 alcohol-related traffic deaths per day.

With so many people celebrating on New Year’s Eve, many people make the poor choice of getting behind the wheel after drinking. When drivers choose to drive under the influence, it not only threatens the lives of themselves and others, but leads to legal ramifications.

Families of car accident victims in Pennsylvania have the right to seek damages from reckless motorists on behalf of lost loved ones. They would be advised to seek the services of an experienced auto accident attorney who will examine all circumstances surrounding an accident to determine which driver was negligent. If you or a loved one were injured over the New Year’s holiday in a car crash, the Philadelphia car crash lawyers at Cherry Fieger & Marciano, LLP can offer you a free consultation. Driver Loses Control of Vehicle, Crashes Into South Jersey Bar

On January 5, a driver apparently lost control of his car on Route 9 in NJ and hit a fire hydrant and a utility pole. He then crashed into Gregory’s Bar & Restaurant at the Jersey Shore, which had about 100 patrons at the time. According to an article on Philly.com, a passenger was killed and two people were seriously injured.

The article did not say if the driver was under the influence of alcohol or drugs at the time of the accident; however, it was reported that he was speeding.

Speeding is just one form of reckless driving and a motorist who fails to adhere to traffic laws and safe driving practices can be held legally responsible for any injuries or fatalities caused by an auto accident.

The patrons of this restaurant were extremely lucky that they were not injured. Sadly, the passenger in the car was killed and an innocent pedestrian was injured. The families of these accident victims have the right to seek damages from the reckless motorist. They would be advised to hire an experienced auto accident attorney who will examine all circumstances surrounding the accident to determine who was negligent.

Auto accidents throughout the United States are an unfortunate reality in our fast paced society. Manhunt for Driver in Fatal Philadelphia Drunk Driving Car Crash

Police are looking for Kenney Bellegarde, a 21-year-old from Philadelphia accused of vehicular homicide for the death of Vanessa Tomlin of New Jersey in a car crash in October. Tomlin was a passenger in the vehicle Bellegarde was driving while intoxicated and was killed in the car accident. The Philadelphia Inquirer reports that Bellegarde was drinking at a wedding prior to the crash and had a BAC almost double the legal limit at the time of the Pennsylvania car accident.

Anyone with information regarding Mr Bellegarde’s whereabouts is urged to call the local police department or the Crime Commission tip line at 215-546-8477 or 877-345-8477.

In the United States, about a third of all car crashes are alcohol-related. In 2009, 10,839 people lost their lives because of an accident that involved a driver with a BAC of .08 percent or higher. In Pennsylvania, there were 406 deaths that year from alcohol-related car accidents.

In Pennsylvania car crash cases where negligence or wrongdoing is involved, the family of a deceased auto accident victim can file a wrongful death claim seeking compensation for damages. Not only is Mr. Bellegarde both criminally and civilly liable, but an experienced wrongful death attorney will also investigate if anyone serving him alcohol at the wedding reception was aware that Bellegarde was beyond the legal limit. They could also be held legally responsible for the fatal car accident.

In Pennsylvania, there are dram shop laws in place to hold restaurants, bars, or other establishments that sell alcohol to a visibly intoxicated person accountable for injuries or fatalities caused by a person who chooses to drive drunk following heavy drinking at an establishment. Because these laws are complicated, it’s recommended that an experienced PA liquor liability lawyer conduct a thorough and independent investigation following a car crash in Pennsylvania involving a drunk driver.

Bar and restaurant owners must train their staff so that they can identify intoxicated patrons and stop serving them when they see visible signs of intoxication. If you are dealing with the aftermath of a fatal DUI car accident, please call the Pennsylvania car accident lawyers at Cherry Fieger & Marciano, LLP to find out more information about how to pursue your legal rights as a victim.

Pennsylvania Couple Killed in Tragic Car Accident in NY

Richard and Kristin Holmes, of West Chester, Pennsylvania were killed in a car collision on a snowy road in New York, 11 miles from Utica on December 28. Philly.com reports their car skidded sideways into an oncoming vehicle. Their two daughters were passengers in their vehicle but were not seriously injured. The driver of the other vehicle was also survived the crash.

According to police, both the winter weather conditions as well as speeding contributed to the fatal car crash. Ice, snow, and other weather conditions cause numerous accidents each year in the United States. In 2008, there were 11, 560 car crashes during snow, sleet, or freezing rain, which results in 55 fatalities. When roads were snow covered or slushy that year, it led to 8,190 car accidents. Earlier this week, state police reported numerous car collisions caused by the extremely cold temperatures and severe winds.

When winter storms strike, it is important for all drivers to avoid traveling, if possible. If you must travel, PennDOT recommends keeping a safe distance between cars and driving more slowly. This allows you to be in control of your car and better able to handle slippery spots. You should also remember to have an emergency kit that includes food, water, a shovel and extra clothing.

If you or a loved one are injured in a car accident this winter, be sure to seek the advice of an experienced Pennsylvania car crash lawyer. At Cherry Fieger & Marciano, LLP our attorneys are highly skilled and will review all the facts surrounding an accident to determine if another’s negligence contributed to the crash. A hit-and-run accident victim who was rear-ended on December 22 was able to help police in Chester County, PA catch the hit-and-run driver who was also allegedly speeding as well as driving while intoxicated. According to an article in The Philadelphia Inquirer, the victim led police to the driver who was also driving without a license.

In this case, the driver broke many laws. He drove under the influence of alcohol, was speeding, caused a car crash and left the scene of the accident. In addition to being criminally prosecuted, he can also be held civilly liable for any injuries the accident victim suffered because of his negligent actions. By law, drivers are obligated to help an injured person after an accident by calling the police and emergency medical services, if needed.

Alcohol Increases the Risk of Fatal Holiday Accidents

According to the National Highway Traffic Safety Association (NHTSA), on average, approximately 28 percent of December car accidents nationwide involve drunk drivers. However, this number increases to 40 percent on Christmas and New Year’s, making alcohol and holiday travel a dangerous and sometimes deadly combination.

The percentage of fatal traffic accidents involving alcohol is highest over New Year’s Eve and New Year’s Day, according to the NHTSA, though the percentage is just a bit lower for Christmas Eve and Christmas Day. The NHTSA includes both car crashes and motorcycle accidents in its percentages.

The number of fatal accidents caused by drunk drivers has decreased steadily since 1982, thanks in part to increased awareness of the danger of drunk driving as well as to increased police patrols and other safety measures. Unfortunately, the number of fatal accidents involving a drunk driver still peaks around the December holidays. Even though the overall number of accidents has gone down, half the accidents that do occur on Christmas or New Year’s still involve drunk drivers, according to the NHTSA.

You can help protect yourself and your loved ones first by never driving while drunk or “buzzed” and never allowing a friend or family member to do the same. Call a cab or choose a designated driver who will be sober the entire night. You may also wish to arrange your holiday plans so that you do not drive during Christmas or New Year’s at all, particularly at night.

Driver of PA Hit and Run Car Crash Sentenced to Prison

On November 22, a Philadelphia judge sentenced Nicholas Hasselback of Ephrata, PA, to 3 to 6 years in prison for a hit-and-run car crash that critically injured Tony Foltz, a Temple University student. According to The Philadelphia Inquirer, immediately after the Pennsylvania car accident, Hasselback swept up broken glass from his vehicle and drove away.

In Pennsylvania, the law states that the driver of a vehicle involved in a car accident that results in injury or death of a person shall immediately stop their vehicle at the scene of the car crash or as close as possible but shall then return to and in every event shall remain at the scene of the Pennsylvania car accident until he/she has given information and rendered aid.

The drivers of both vehicles involved were killed and 3 passengers were seriously injured. According to Philly.com, one of the vehicles had been traveling north in the southbound lanes.

Aggressive Driver Leads Police on Chase, Causes PA Car Crash

On November 10, Kyle Malcolm Washington led police on a chase that included speeding, running stop signs, and endangering construction workers. He eventually struck a vehicle and then fled the scene of the Pennsylvania car accident. According to an article in The Delaware County Times, the driver of the vehicle that was struck suffered injuries.

Motorists like Washington who fail to adhere to traffic laws and safe driving practices are ultimately responsible for causing Pennsylvania car crashes. Traveling at speeds greater than posted speed limits is a form of aggressive driving. The National Highway Traffic Safety Administration (NHTSA) defines aggressive driving as a driver who commits a combination of moving offenses so as to endanger persons and property. Negligent drivers’ unsafe driving practices are an intentional decision to violate a combination of basic traffic laws. Aggressive driving kills an estimated 1,000 people a year.

When drivers are traveling at excessive speeds, the Pennsylvania auto accidents they cause are often very severe and may result in a victim suffering life-changing and sometimes permanent injuries. A high number of fatalities also result from aggressive driving car accidents.

If you or a loved has been involved in a Pennsylvania car crash caused by an aggressive driver, you may seek damages for your injuries, including compensation for loss of income, pain and suffering, disability, medical expenses, and even punitive damages to punish and discourage the negligent person from unsafe and reckless conduct.

Philadelphia Woman Sentenced in Fatal A.C. Expressway Car Crash

Sheila McCrea was recently sentenced to 6 years in prison after she crashed her car on the Atlantic City Expressway on July 19, 2009. According to The Philadelphia Inquirer, her blood-alcohol level was 0.201 % when she swerved into a guardrail, killing her daughter’s friend and injuring her daughter and two nieces.

On average, every day 1.5 persons are killed and 26 people are injured in alcohol-related traffic crashes. In 2008, in Pennsylvania, 534 people died in alcohol-related crashes. Ninety percent of the alcohol-related occupant deaths were in the vehicle driven by the drinking driver; 75% were the drinking drivers themselves.

Individuals like Ms. McCrea who are deemed responsible for causing a fatal Pennsylvania car crash can be held liable for having done so in a court of law. Families of car crash victims have the right to seek damages from reckless motorists on behalf of lost loved ones, and the best strategy in doing so is to retain the services of an experienced car collision attorney who will examine all circumstances surrounding an accident to determine the negligent parties involved.

Route 119 Dump Truck, Car Crash Kills Sisters

Two sisters from Perryopolis were riding in a compact car on Route 119 in Westmoreland County recently when their car collided with a dump truck, according to a recent news story released by WTAE Channel 4 Action News. Although both were wearing seat belts, the sisters did not survive the Pennsylvania car accident.

According to police, poor visibility may have played a role in the accident. The dump truck driver said that he did not see the sisters' Ford Focus because it was in a shadow cast by a nearby bridge. He heard a vehicle's tires squeal as if braking suddenly, then felt his truck hit a vehicle in front of him. The dump truck driver swerved to avoid hitting the car as much as possible, spilling much of the truck's load of sand onto Route 119.

Police are currently interviewing several eye witnesses. They have also impounded the dump truck and will have it examined to determine if a mechanical failure caused or contributed to the accident. Residents along that part of Route 119 say that Pennsylvania car accidents caused by speeding are common in the area.

Car accidents claim the lives of too many Americans each year. Crashes involving large trucks can be even more deadly, as a larger, heavier truck often does more damage to a vehicle than another passenger vehicle of similar size. If you or someone you love has been injured in a Pennsylvania car accident, please contact the experienced Pennsylvania car crash attorneys at Cherry Fieger & Marciano, LLP. Our skilled legal team will help you win the compensation you deserve from anyone whose negligence or carelessness resulted in your injury. Driver Used Drugs Prior to Fatal Car Crash

On October 12, Ryan Lippincott was charged in connection with a DUI accident on March 18 in Burlington County, NJ. While under the influence, Lippincott drove his car into oncoming traffic, killing 27-year-old Jonathan Hinkson, a music teacher at Volz Middle School.

According to the Philadelphia Daily News, Lippincott had inhaled an aerosol can of cleaner (known as “huffing”) and also used marijuana just before driving his car. He was charged with vehicular homicide, assault by auto and possession of alcohol by an underage person, and held on $100,000 bail.

In 2008, PennDOT reported 534 deaths due to alcohol-related accidents. The Centers for Disease Control and Prevention (CDC) reported that 18 percent of motor vehicle driver deaths in the United States involve drugs other than alcohol, such as cocaine or marijuana. However, these types of drugs are often used in combination with alcohol.

In Pennsylvania, it is illegal to drive under the influence of any intoxicant, whether it’s alcohol, recreational drugs or prescription drugs. If “huffing” a chemical gets a driver high, then that driver is impaired and should not get behind the wheel of a car.

Every year thousands of U.S. motorists lose their lives in auto accidents. The National Highway Traffic Safety Administration (NHTSA) reported that more than 34,000 fatal car crashes took place in 2008. Unfortunately, negligent action is typically at the heart of most car accidents, and innocent motorists are all too often injured at the hands of a reckless driver.

In negligent cases similar to Mr. Lippincott’s, a victim and/or their family can seek compensation for medical expenses, loss of wages, and other accident related damages.

If you have lost a loved one in a fatal Philadelphia car crash, contact the Pennsylvania wrongful death attorneys at Cherry Fieger & Marciano, LLP for a free evaluation of your car collision case. Our Pennsylvania auto accident attorneys can work to hold negligent parties accountable for their actions and seek compensation on behalf of you and your loved ones. Fatal Philadelphia Head-On Ambulance Collision Kills Driver, Injures Others

Drag racing may have been the cause of a head-on crash between a 19-year-old Glenside man and an ambulance at Broad and 66th Streets in Philadelphia on October 9, killing the 19-year-old. According to Philly.com, the fatal Philadelphia car accident also injured his passenger as well as the passengers in the ambulance.

Emergency Medical Services (EMS) personnel face many hazards while on the job, one of which is ambulance crashes when responding to an emergency call or transporting patients to a healthcare facility. EMS workers riding in ambulances can themselves be victims as well as other passengers and patients in an ambulance.

Negligent action was at the heart of this fatal Pennsylvania accident. Innocent motorists are all too often injured at the hands of a reckless driver. There are many forms of reckless driving, including: failing to yield at stop signs and traffic signals; traveling over the posted speed limits, or those that are reasonably safe to travel at given road conditions and inclement weather; using a cell phone or performing other tasks while driving; making right and left turns without using a blinker or checking to see if there is oncoming traffic.

Individuals who are deemed responsible for causing a fatal Pennsylvania car crash can be held liable in a court of law. Families of Philadelphia car accident victims have the right to seek damages from reckless motorists on behalf of lost loved ones. The best strategy is to retain the services of an experienced Pennsylvania auto accident attorney, who will examine all circumstances surrounding a fatal car accident to determine the negligent parties involved. Local College Students Killed in Hit-and-Run Accident

The Delaware County Times reported on September 29 that police were searching for a driver who allegedly stole a Range Rover SUV and crashed it into another car while going at least 100 mph. A Villanova student was killed by the hit-and-run driver and another student was critically injured.

The National Highway Traffic Safety Administration (NHTSA) reports that almost 11% of all vehicle accidents are hit-and-run car crashes. Each year, nearly 700,000 hit-and-run car accident cases are reported in the United States.

If it is determined that the driver of the Range Rover was at fault for this tragic Pennsylvania wrongful death auto accident, he could face additional criminal charges besides the hit-and-run charge. The driver may also be held financially responsible for the injuries or damages they caused. If a driver’s negligence is determined to have caused the wrongful death of another, family members of deceased victims can file a wrongful death claim seeking compensation for medical costs, funeral expenses, lost future income, loss of love and companionship, and other related damages. An experienced Pennsylvania wrongful death car accident lawyer will be able to advise victims and their families about their legal rights and options.

Pennsylvania Parents Push for Teen Driving Reform, Legislators Not Listening

Many parents who have lost children in fatal Pennsylvania car accidents are calling on legislators to pass House Bill 67, which would prohibit teen drivers from using a cell phone while driving and having more than one non-family teen in the vehicle. But legislators aren’t listening, according to The Mercury. The parents of two teens who were killed last year started working toward teen driving law reform just a few months after the loss of their sons. Until teen driving law reform is in effect, many say that the risk of accidents, injury and death will increase.

Local legislature returned from the summer recess and will leave again to campaign for the November 2 election; therefore, the window to make any progress on House Bill 67 is closing fast. It is unclear at this time as to whether or not there will be a winter session. So far, while the parents of teens who have been lost in fatal Pennsylvania car crashes have been adamant, legislators have failed to do anything to prove that they’re paying attention.

According to the Centers for Disease Control and Prevention, in 2008, about 3,500 teens lost their lives in car crashes nationwide with more than 350,000 treated for serious injuries. The risk of teen drivers getting into an accident increased with the number of other teen passengers in the vehicle.

If you or a loved one has been injured or if you have lost a loved one due to the inexperience or negligence of a driver, it is highly recommended that you retain the services of a qualified Pennsylvania auto accident attorney. An injury sustained in an auto accident can take a heavy toll on the injured individual and their family. Medical bills, lost wages and other damages can build up quickly and the skilled lawyers at Cherry Fieger & Marciano, LLP can help. ATV Accident Kills Young Girl

A sixth-grader from Delaware was killed on September 15 in a tragic all-terrain vehicle accident. The Philadelphia Inquirer reported that she was driving a 2003 Honda Recon ATV at her grandfather’s house. She became pinned under the ATV after it flipped backward and she hit her head on the driveway.

This wrongful death accident shows that children do not have the skills to drive an all-terrain vehicle. They do not have the judgment to use them safely. If they ride along as passengers, they need to be restrained and wear safety gear, such as a helmet.

In fact, the American Academy of Pediatrics (AAP) recommended that children below the age of 16 do not ride an ATV. The AAP mandates that only persons above the age of 16 with an automobile driving license and some ATV use certification should be allowed to ride these vehicles.

Sadly, www.atvsafetynet.com reported that 40,000 families a year were suffering the tragedy of death and serious injury to their children from these accidents. Between 1995 and 2005, ATVs killed at least 1,218 children under age 16, which is about 27 % of all ATV-related deaths during that time.

The family of this young girl would be well advised to contact a Pennsylvania personal injury who has experience dealing with ATV accidents and ATV rollover cases. An expert should examine the ATV involved for vehicle product defects.

If you or a loved one has been injured in an ATV accident in Pennsylvania, please contact an experienced Philadelphia personal injury attorney. Cherry, Fieger, and Marciano will investigate the accident to determine if it was the result of someone’s negligence.

Car Accident in Philadelphia Kills Two

A car crash on August 29 on South 61st Street in Philadelphia, PA left two men dead. An article on Philly.com reported that a man in a black Chevrolet was speeding and drove into oncoming traffic. He hit a man, 38, driving a blue Chevy SUV and both men were killed in the accident.

According to the AAA Foundation, excessive speed was the cause of more than half of fatal crashes from 2003 through 2007.

PennDOT statistics from the past few years show that aggressive driving continues to be the number one killer on PA roads. In addition to speeding, other forms of aggressive driving include: accelerating rapidly; tailgating;
running stop signs or red lights; making frequent lane changes to advance ahead of other traffic; using a cell phone while driving; passing cars using an emergency lane, turning lane or unpaved shoulder; racing other vehicles; braking suddenly or cutting off another vehicle.

In 2007, aggressive driving played a role in 971 fatalities. From 2003-2008 aggressive driving killed 4,640 motorists. In 2007, there were 130,564 crashes on Pennsylvania roads and aggressive driving played a role in 74,887 of those crashes.

Fatal Chester County SUV Rollover Accident

On November 23, a 16-year-old crashed his SUV and killed two teenage friends. The teen is accused of being under the influence of marijuana at the time of the crash.

The Chester County Court Juvenile Master decided that the teen should remain at the Chester County Youth Center until an adjudication hearing.

The Assistant District Attorney argued that the teenager recently posted entries on Facebook indicating that he was unremorseful and still getting high. According to the article, the teen described using marijuana and getting drunk on New Year’s Eve.

A 17-year-old male and a16-year-old male, both 11th graders at Pottsgrove, died in the crash.
The teen motorist was charged with two counts of homicide by vehicle while driving under the influence, six counts of reckless endangerment, and driving without proper insurance. He was traveling westbound on Route 724 with five friends on November 23. He veered into the eastbound lane and traveled up an embankment. The SUV rolled over and landed in the eastbound lane, colliding with a Nissan sedan.

The teen driver and three passengers were injured. The Nissan’s driver also was injured.
The drive in this accident could be held both criminally and civilly responsible for the deaths of the two teenagers. Their families would be well advised to seek the advice of an experienced Pennsylvania wrongful death attorney.

Woman, 2 Children Survive 60 Ft Fall in Pennsylvania Car Accident

A woman and her two children survived a 60 foot fall when their car was bumped on I-79 near Waynesburg, an article in the Pittsburgh Post-Gazette reports. Another driver had moved into the left lane on the highway and bumped the rear of the woman’s car, which sent it onto a jersey barrier where the car continued to travel for 30 feet. The vehicle then sailed 100 feet over the edge of the bridge before rotating in the air and falling 60 more feet to Route 188 below. The vehicle landed on its roof and all occupants survived with minor injuries.

Police say that summary charges may be filed against the driver who bumped the woman’s car, but that the investigation is still open and they are checking to see whether or not mechanical problems played a role in causing this Pennsylvania auto accident.

Considering the severity of this accident, it’s nothing short of amazing that the three occupants of the fallen vehicle walked away with non-life threatening injuries. Should the investigation determine that a mechanical defect was partially or fully responsible, the woman may want to consider filing an auto product liability lawsuit.

At Cherry, Fieger & Marciano LLP, our Pennsylvania auto product liability attorneys understand the complexities that go into an auto product liability claim. Washington County Intersection Auto Accidents Lead to Wrongful Death Suits against Penn DOT

Several families of victims killed at a Washington County, PA intersection during the past two years are suing the Pennsylvania Department of Transportation. The lawsuits claim that the agency knew since 1994 that the intersection was dangerous and were negligent regarding its design, construction, and maintenance.

According to this article, there were 90 accidents reported to the police at the intersection of state Route 136 and Church Road in Somerset over the past 10 years. The families claim that PennDOT is liable for allowing this intersection to exist.

The intersection is on a highly traveled road and the grading and curvature of Route 136, makes it difficult for drivers approaching in both directions to see opposing traffic.

The wrongful death lawsuits also said that PennDOT failed to use adequate traffic control devices.

Three Philadelphia Men Killed in AC Expressway Accident

Three men in their twenties, all from Philadelphia, were killed on June 25, 2010 when the vehicle in which they were traveling went off the Atlantic City Expressway in NJ and hit several trees, according to the Philadelphia Daily News.

The three men were killed after their vehicle went out of control on the expressway. It left the roadway and struck trees in the center median. The three men were pronounced dead at the scene.

A mother of one of the victims said that the men used her 2001 Saab to go to Atlantic City.

Unfortunately, the victims were not wearing seat belts. According to the PA Department of Transportation, the combination of lap/shoulder seat belts, when used, reduces the risk of fatal injury to front seat passenger car occupants by 45% and the risk of moderate-to-critical injury by 50%. In fact in 2008, there were a total of 1,468 traffic deaths and 322 of those people would have survived if they had worn their seat belts.

Pennsylvania Car Accident Statistics

Here are some interesting statistics recorded by the PA Department of Transportation in 2006 regarding car crashes in the state of Pennsylvania. The report’s statistics are based upon reportable accidents, or any accident that was reported by the police. 1,300 Police Departments in Pennsylvania provide the Department of Transportation with this information. The report given cannot account for unreported accidents, which unfortunately leaves some accidents unaccounted for.

According to a 2006 report from Pennsylvania Department of Transportation, there are 67 counties made up of 2,500 municipalities in the state of Pennsylvania that are connected by over 120,000 miles of roads and interstates.

According to information gathered from the Pennsylvania Department of Transportation, there were 128,342 reportable vehicle accidents in the year 2006. The department stated that along with the almost 130,000 accidents, there were 96,597 people injured, and 1,525 people killed. Despite these numbers, the number of reportable crashes has been its lowest in the last five years according to the Department’s report. This means that on average, 15 reported accidents occurred per hour, and about 352 reported accidents occurred each day. Of these car accidents in Pennsylvania, there were 265 people injured each day, at about 11 people per hour. Four fatalities occurred each day, or one every six hours.

Fatal Chester County Crash

Thomas Patrick Brandon was making a delivery to the Chester County Prison in Pennsylvania on the morning of April 13, 2009 when his delivery truck crashed into a car stopped for a traffic light on Route 202. According to this article in the Delaware County Times, it caused the car to burst into flames, killing its driver, Daniel Lopez, of Phoenixville.

Brandon, 48, of Penndel, Bucks County, will begin an 11½- to 23-month prison term for criminal charges resulting from that crash.

The article said that Lopez was on his way to work when the crash occurred on Route 202 at Greentree Drive in Thornbury. He was stopped for a traffic light in his Chevrolet Cavalier behind a Pontiac Sunbird.

A crash reconstruction team determined Brandon was traveling about 67 mph when his truck struck the rear of Lopez’s car. Investigators found no evidence that Brandon had tried to slow down until just before impact.

The force of the crash pushed Lopez’s car into the Pontiac.

Brandon’s blood test showed the presence of THC, the main psychoactive substance in marijuana, although the intoxication level was insufficient for authorities to prove it had caused the crash. Brandon was charged with homicide by vehicle while DUI.

Lopez’s wife is pursuing a civil suit against Brandon and his former employer for her husband’s wrongful death.

Interstate Collision in Philadelphia Hospitalizes Three

An early morning auto accident in Philadelphia on I-95 North left two state troopers and a tow truck operator with mild to severe injuries. News source philly.com reports that the pair of authorities had been working with the professional driver of a tow truck to remove a vacant car that had been obstructing a right highway lane near the Girard Avenue exit. As the three men were attaching the car to the driver’s tow truck, a 23-year-old man driving a Toyota Corolla full of passengers collided with the troopers’ patrol car, which was parked behind the abandoned vehicle.

The driver of the tow truck had been working underneath the abandoned automobile at the time of the collision and suffered injuries, but managed to escape quickly to help another who was clearly in pain.

One of the trooper pair had been standing behind the abandoned vehicle, and was immediately trapped between two cars as his patrol car was forced forward by the collision. The second trooper leaped out of the way of the reckless on-comer, but did not escape without his share of scratches and scrapes from the land.

The three men were rushed to a nearby hospital. The tow truck operator, who suffered damage to his upper-body, and second trooper were released early, but the remaining trooper was kept in the hospital for critical knee injuries.

Pennsylvania Senator Dies in Fatal Accident

Breaking news from the Associated Press reports that on Wednesday, February 10, 2010, the wife of a late Pennsylvania Senator testified in court against the alleged drunk driver who suddenly smashed into her and her husband’s car, killing the politician as they were on their way to an awards ceremony. The fatal car crash happened in autumn 2008 on Pennsylvania Route 209 between the traveling couple, who drove a Cadillac, and an auto mechanic who was driving a pickup truck.

The driver of the pickup rejects accusations of driving while intoxicated, but several witnesses say the mechanic’s breath reeked of alcohol and authorities report the man’s blood-alcohol levels tested 4 times beyond the state limit. Police also say the truck ran into the couple’s Cadillac so violently that the Cadillac spun around multiple times and caused damage to a minivan parked on the road’s shoulder. The minivan passengers were not physically harmed, but the Pennsylvania Senator reportedly died within 18 hours of the accident and his wife sustained critical injuries including a pierced lung, fragmented knee, and cracked ribcage.

Pennsylvania Buckles Up

The Pennsylvania Department of Transportation has announced on its website that a record number of drivers are utilizing their seatbelts while on Pennsylvania roads, a whopping 88% of them. The previous high was reported in 2007 when 87% of drivers reported buckling up.

Secretary of Pennsylvania DOT, Allen D. Biehler, P.E., said, “The simple act of putting on a seat belt or properly restraining your child is the one step you can take to increase your chances of surviving a crash. PennDOT will continue to encourage every driver to buckle up and make sure everyone else in their vehicle does, too.”

Another factor for the record seatbelt use is that law enforcement has been boosted with 450 municipal and Pennsylvania State Police taking part in the statewide “Click It or Ticket” campaigns. Officials reported that more than 10,000 seatbelt citations were given this past year. Federal Funding provided the $2.5 million for the program that also included education in K-12 schools. Approximately 47,000 students are believed to have been reached.

Burlco Man's Suit Has Toyota Safety Data at Its Center

A man from Tabernacle, PA said a defective Toyota seat belt contributed to his paralysis. According to an article in The Philadelphia Inquirer, he thinks that the company may be withholding crash data that could prove it.

The injured man’s attorneys argued in court that Toyota had been evasive when asked whether crash-test videos still exist for the 1991 short-bed, deluxe pickup.

On January 4, 2005, as the plaintiff was heading to work, he stopped to make a left turn onto in Barnegat, Ocean County, NJ and was struck from behind and then by a second vehicle. He filed a year later against the first driver, Toyota, and the seat-belt manufacturer. The man’s legs are paralyzed, although he does have some upper-leg strength that allows limited walking with a walker or crutches.

The seriously injured man claims that he was wearing his seat belt because he always buckled the restraint before starting the vehicle, as required by his employer.

There are allegations in California accusing Toyota of withholding and destroying evidence during civil litigation in unrelated cases. The man’s attorneys said this may be indicative of a widespread practice to conceal damaging evidence.

On October 9, a Superior Court Judge ruled that the company had an obligation locally to clarify whether videos or other electronic information exist showing that vehicles have been properly tested and met all safety standards.

The plaintiff’s lawyers allege that the seat belt, with a design defect, opened upon impact and that he was thrown into the dashboard with such force that he fractured vertebrae. Had the seat belt worked properly, the man would not have been thrown from his seat.

One of his attorneys also alleges that Toyota engineers knew in 1991 the seat belts installed in some vehicles were defective and that they later installed a properly designed belt. But the company never issued a recall.

The case is scheduled for trial in February.

According to the article, attorneys for the injured man are questioning if the company has a broad practice of withholding evidence.

Almost 6,000 Deaths Caused by Driver Distraction

The Obama administration reported on September 30 that nearly 6,000 people were killed and a half-million injured last year in vehicle crashes connected to driver distraction, an indication of the dangers of using mobile devices behind the wheel.

According to an article, the Transportation Department was bringing together experts over two days for what was called a “distracted driving summit” to take a look at the highway hazards caused by drivers talking on cell phones or texting from behind the wheel. Secretary Ray LaHood said the administration would be developing ways of curbing distracted driving.

Transportation officials said in a research report that 5,870 people were killed and 515,000 were injured last year in crashes where at least one form of driver distraction was reported. Driver distraction was involved in 16 percent of all fatal crashes in 2008.

The panel of government officials, safety advocates, researchers and lawmakers hoped to develop a consensus on the roadway hazards and hear warnings from young adults who caused car accidents because they were texting while driving.

The new data underscored the major problem of distractions involving young drivers. The greatest proportion of distracted drivers were those age 20 and under. Sixteen percent of all under-20 drivers involved in fatal crashes were reported to have been distracted while driving, the government said.

Man Responsible for Fatal Accident Had Series of Arrests

On September 12, a Lower Township, NJ man was killed, and his wife and teenage daughter critically injured, when a man’s car crossed the center line on a curve and hit their car. According to an article in The Philadelphia Inquirer, the driver of the vehicle responsible for the accident was charged with death by auto and driving while intoxicated. This is his eighth drunken-driving arrest since 1996.

For 13 years, the legal system has tried to stop this particular man from drinking and driving. He was sent to alcohol treatment and to jail and his driver’s license was taken away. Yet the Philadelphia resident continued to get arrested.

Mothers Against Drunk Driving is pushing for tougher legislation to target repeat offenders because the recidivism rate among drunken drivers is so high. Fatal Montgomery County Auto Accident

A man was killed in a Montgomery County car accident in PA after a driver crossed into opposing lanes of traffic and struck his vehicle. According to a CBS news report, a 23-year-old man was heading west in a 2002 Buick station wagon when for an unknown reason, he crossed over to the eastbound lanes striking a 2006 Suzuki sedan. The driver of the Suzuki was pronounced dead at the scene. The driver of the Buick and a 50-year-old passenger were hospitalized with injuries.

Traffic accidents occur for a variety of reasons. In this particular case, it's not clear what caused the driver of the Buick to cross over to opposing lanes of traffic. These accidents could occur due to driver error – possibly an impaired, speeding, reckless or distracted driver. Or they could occur because the car had a mechanical problem. If such an accident were to be caused as a result of the driver's fault, the injured party or his family could seek compensation from the "negligent" driver.

Lawsuit in Fatal DUI Bicycle Accident Settled

The family of a bicyclist who was killed two years ago after being hit by a drunk driver in a bicycle accident in Pennsylvania, has entered into a settlement with the driver and the restaurant blamed for selling alcohol to her even after she was intoxicated. According to this news report the fatal bicycle accident occurred Feb. 11, 2007 when the woman was driving after celebrating her birthday at a local restaurant with family members. Her blood alcohol content (BAC) was more than three times the legal limit, which is 0.08 percent in Pennsylvania. Last year, the woman pleaded guilty to homicide by vehicle and was sentenced to six years in state prison.

The lawsuit, filed in Lancaster County Court, asked for $100,000 in damages from the defendants. The lawsuit alleged that the restaurant sold liquor to the driver and her husband even after they were visibly intoxicated and failed to make sure that they had an alternative way to get home so neither one of them would have to drive. But attorneys for the restaurant argued that the woman did not appear intoxicated when she was at the restaurant.

Pennsylvania dram shop liability laws usually cover places of business that serve alcohol including liquor stores, bars, restaurants and clubs. These laws impose liability on businesses when they serve alcohol to someone underage or an individual who is already intoxicated who then goes on the break the law or cause an auto accident in Philadelphia that injures themselves or others. These cases are complicated because the indicators of intoxication can be contested as they were in this particular case.

The victim suffered severe injuries and died at the scene. SEPTA's systems safety engineers are looking into the condition of the bus' brakes and other aspects of its equipment. The bus driver has apparently been a SEPTA bus operator for 16 years. The driver is also being questioned and tested for drugs and/or alcohol. In this case, if the bus driver was found to have been driving recklessly or operating under the influence, both he and his employer, South Eastern Pennsylvania Transportation Authority (SEPTA), can be held liable.

SEPTA can also be held liable if it is determined that they did not maintain their vehicles properly and that their bus suffered a mechanical malfunction as a result of that lack of vehicle maintenance. If that Philadelphia intersection is determined to be a dangerous roadway or intersection, the city could be held liable for the bus accident in Pennsylvania.

In such auto versus pedestrian accidents, the victims' families would be well-served to consult with an experienced Philadelphia auto accident attorney, who will be able to thoroughly examine the investigative reports and determine exactly who should be held accountable. Montgomery County Truck Accident Charges Driver

On Jan. 23, a tractor-trailer plowed into stalled traffic on the Schuylkill Expressway, killing a father of three. According to the article in the Philadelphia Inquirer, the tractor-trailer had been cited repeatedly for faulty brakes and was operating with a fraudulent inspection sticker.

After a seven-week investigation of the truck accident, authorities charged the driver, Valerijs Belovs of Northeast Philadelphia, as well as the co-owner of the 18-wheeler and a garage owner, with vehicular homicide.

Montgomery County District Attorney said the truck’s worn-out brakes prevented it from stopping in time before it plowed into halted east-bound traffic on the Schuykill. The truck went over the top of one car, killing its driver, David Schreffler, and injuring an occupant, Joseph John Maylish, and smashed into three other vehicles in this fatal auto accident.

Although the 18-wheeler bore current state inspection stickers certifying the tractor and trailer to be in good working order, the crash police mechanics found the rig’s brakes to be defective. None of the 10 brake assemblies worked efficiently, and three brake assemblies “failed completely.”

The bus driver and other children in the bus were not injured in the accident. Kriner has been cited for traffic violations including failure to drive a vehicle at a safe speed, careless driving and meeting or overtaking a school bus, the report said.

Gloucester County Auto Accident Seriously Injures Two

A Gloucester County two-car collision that occurred at the intersection of Route 42 and Tuckahoe Road has injured the drivers of both the vehicles, reports the CourierPostOnline.com in a recent article. Britain Matchner, 51, of Williamstown was driving a 1988 Ford pick-up truck when he rear-ended 49-year-old Stefanie Hecksher.

According to officials, Franklinville resident Hecksher had parked her Lincoln Town Car at a resting stop in Washington Township at County Route 555 when she was hit by Matchner’s truck. The Lincoln reportedly caught fire, but police were able to rescue Hecksher before any major burn injuries. Both Matchner and Hecksher have been admitted to area hospitals for treatment of their injuries. Authorities are still investigating the auto accident in Pennsylvania and have not filed any charges at this time.

Based on this account, we don’t know what exactly caused the collision. It is not clear if Matchner was speeding or if he was distracted and inattentive. Also, the report does not say whether the right lane of the road on which the Lincoln was parked was a designated spot meant for use as a resting spot. Rear end auto accidents in Philadelphia are very common and typically tend to cause whiplash injury. It is estimated about 20 percent of people involved in rear end collisions exhibit symptoms of whiplash. The National Safety Council puts the annual figure for reported rear end collisions at more than 2.5 million.

Lehigh County Motorcycle Accident Kills Woman

A Bucks County high school teacher faces vehicular-homicide charges in an October accident that killed a motorcyclist in Lehigh County. According to this article in the Philadelphia Inquirer, Larry Angney II, 37, of Center Valley, PA is accused of killing Lori Smeltzer, 45, near her home in Upper Saucon Township. The article said that his vehicle struck Smeltzer’s motorcycle from the rear and ran over her before speeding from the scene. She died the next day.

Angney turned himself in the day after the car accident in Pennsylvania, saying he thought he had hit an animal or a street sign.

He was charged Friday with vehicular homicide.

Angney should be held criminally and civilly responsible for the accident, injuries, and the death of Smeltzer. Smeltzer’s family deserves to be rightfully compensated for their tremendous loss. They would be well advised to contact an experienced Philadelphia wrongful death attorney.

Though motorcycle accidents in Pennsylvania have a variety of causes, common causes include unsafe road conditions, inclement weather, defective motorcycle parts, driver fatigue, drunk drivers, and driver error. The latter is the most common cause of motorcycle accidents. Some passenger vehicles simply don't understand the rules of the road and may hit a motorcycle while changing lanes, may disregard their presence on the road, or ignore right-of-way laws.

Two former University of Rhode Island students have settled a lawsuit that accused them of causing the death of a college student from Richboro, Bucks County, Pa., who was crushed by a bus in Newport, R. I. in 2004 in a bus accident.

According to this article by the Associated Press that appeared on Philly.com, the two students, Jarrad Rocheleau and Loren Welsh, reached the agreement with the parents of Francis J. The wrongful death lawsuit began two weeks ago in Superior Court and was resolved before closing arguments on February 10.

Rocheleau and Welsh admitted no wrongdoing as part of the settlement. The article stated that the settlement was for less than the $5 million sought by Marx’s parents.

After a formal dance at one of Newport’s mansions with his girlfriend, Marx got into a heated argument with a group of URI students celebrating their impending graduation with a pub-crawl.

N.J. Pays $2M In Trooper Crash That Killed 2 Daughters

New Jersey has paid $2 million to settle a lawsuit filed by Maria Caiafa, a Cape May County woman, whose daughters died in a car crash with a state trooper. According to this article in the Philadelphia Inquirer, the state made no admission of culpability.

The settlement was signed in May, but the family didn’t announce it because publicity over the wrongful death case makes it hard for them to manage their daily lives.

New rules for medically unfit truck and bus drivers

Federal regulators are now taking steps to get medically unfit truck and bus drivers off the road, in an effort to limit dangerous auto accidents on our nation's highways.

According to this article in the Philadelphia Inquirer, the Federal Motor Carrier Safety Administration approved a rule that states must combine commercial truck and bus drivers' licenses and their medical examination certificates into a single electronic record.

This rule will make it easier to check whether drivers have met medical requirements to operate commercial vehicles.

The administration has also proposed creating a registry of medical examiners qualified to award certificates to drivers. Examiners who do not meet minimum standards could be barred from issuing fitness-to-drive certificates.

According to the article, agency officials were reprimanded at a House hearing earlier this year for ignoring the problem of medically unfit drivers despite repeated warnings from Congress.

The rule finalized on December 1 addresses some of a series of recommendations made by the National Transportation Safety Board in 2001 in response to a motorcoach accident two years earlier in New Orleans that killed 22.

Court revokes bar’s license after crash

A state appeals court revoked a New Jersey bar’s liquor license for serving alcohol to a man who ended up killing 2 people in a 2000 automobile accident.

On November 14, the court upheld the decision by the state Division of Alcoholic Beverage Control (ABC) to revoke the license of Cheerleaders, in Brooklawn, NJ. The bar will have six months to sell its license and pay a fine to the ABC, once the ABC determines what that fine should be.

According to a report in the Philadelphia Inquirer, the court agreed that on April 15, 2000 the bar served alcohol to 23-year-old Humberto Herrera-Salas even though he was intoxicated.

Herrera-Salas was eventually ejected from the bar, drove south in the northbound lanes of Route 130, crashing head-on into another car and killing two people and injuring two others.
Herrera-Salas was sentenced to 22 years in prison.

The owner of Cheerleaders tried to have the ABC's ruling reversed, but the appellate panel focused on the fact that although bar employees forced Herrera-Salas to leave and called him a taxi because he had become drunk and abusive, no one stayed outside to make sure he got in the cab.

Head-on Auto Accident in Pennsylvania Kills 1, Sends Another to Jail

Delco woman faces DUI-related homicide charges

Roisin O'Neill, 22, of Newtown Square, had a blood alcohol content of .197 percent and was under the influence of marijuana when she drove up the off-ramp onto Interstate 476 on Sept. 19, traveling more than three miles in the wrong direction before striking a car operated by Patricia Waggoner, 63 in a fatal Pennsylvania head-on auto accident.

According to a Philadelphia Inquirer report, Waggoner, who was headed to Media to visit family, was pronounced dead at the crash site at 2:30 a.m. Sept. 19. She died of cerebral and chest trauma.

O'Neill’s injuries were described as non-life-threatening.

Montgomery County District Attorney Risa Vetri Ferman said O'Neill was "falling down drunk" when she sped down the Blue Route in the wrong direction flashing her headlights at oncoming drivers. According to the article, Roisin O'Neill met friends just after 10 p.m. on Sept. 18 at Brownies 23 East in Ardmore, PA. She later admitted to police that she had two whiskey drinks before she arrived at the bar and a "beer or two" after she arrived.

Police said they interviewed five drivers who swerved to get out of her way as she drove, flashing her high beams, at high speed in the wrong direction for more than three miles. Waggoner also attempted to get out of the way of the speeding Ford Escape. She swerved her car right just as O'Neill swerved left and head-on into the smaller car resulting in a deadly Pennsylvania SUV accident.

Wrongful Death Lawsuit Allowed To Be Filed By Widow of Auto Accident Victim

A state appeals court ruled that Sevastia Podias, the widow of a motorcyclist who was struck by a car on the Garden State Parkway can pursue a wrongful death lawsuit against two passengers in the car who failed to stop and help him.

The Philadelphia Inquirer reported that the lawsuit against Andrew Swanson, Jr. and Kyle Charles Newell, the two passengers in a car that hit Antonios Podias, may now go to trial.

A trial judge originally dismissed the case against Swanson and Newell in 2006, but that ruling was reversed last year when a state appellate court ruled that the two men had a legal obligation to help Podias. The judge had ruled in March that Podias couldn't sue for the bulk of monetary damages against Swanson and Newell because she had already settled out of court with the driver and other defendants for an amount greater than what a jury had determined was appropriate.

Podias’ husband, Antonios, was riding his motorcycle on the Garden State parkway when he was struck from behind by a car driven by Monmouth University student Michael Mairs, whose blood alcohol level was .085. Mairs, Swanson, and Newell were returning to the Monmouth campus from a party in Matawan.

Mairs' car crashed through a guardrail and stopped on the grass near the highway express lanes following the motorcycle accident. The three men then drove away, and a car driven by Patricia Uribe, another Monmouth student, ran over Podias, killing him.

Court records showed that Mairs, Swanson, and Newell never called for emergency assistance. According to Sevastia Podias’ attorney, experts testified that Antonios Podias suffered some injuries from the impact with Mairs' car but likely would have survived those injuries had the young men called for help.

Middle Paxton Auto Accident Claims Driver’s Life

A man was killed in a Middle Paxton Twp. auto accident on Saturday, October 11 after he lost control and was ejected from his vehicle. State police at Harrisburg said, the man, whose name was withheld pending notification of his family, was pronounced dead at the scene of the crash on state Route 322, two miles east of state Route 325.

Police say the man was driving east on state Route 322 at about 1:30a.m. when he lost control of his 1995 Plymouth Voyager. The vehicle slid sideways for 153 feet, hit a guardrail, spun and ejected the driver, who most likely died instantly.

Dangerous auto accidents involving minivans are not an uncommon occurrence. Minivans roll over frequently due to their higher center of gravity and narrow wheelbase compared to regular sedans. Despite their high rollover risk, minivans do not have proper roof structures and most do not meet the National Highway Traffic and Safety Administration roof safety standards for automobiles.

Hit and Run Driver Seriously Injures Woman

A 36-year-old woman was seriously injured last week when a hit and run driver struck her car and pushed her into oncoming traffic. Not only was the driver driving a stolen car, but he was also under the influence of Xanax during the auto accident.

According to an article in the Delaware County Times, Michael Fabrizio, 21, stole a vehicle parked in Drexel Hill that its owner left running. He then picked up a 16-year-old boy and while driving at a high rate of speed in Upper Darby, smashed into a 1999 Hondo Civic. The Honda was then pushed into oncoming traffic and hit a van head-on. Fabrizio fled the scene of the accident.

Fabrizio is being charged with recklessly endangering a person, receiving stolen property, aggravated assault by vehicle under the influence, accident involving death or personal injury, accident involving damage to attended vehicle, duty to give information and render assistance, and driving under the influence of alcohol or a controlled substance.

Police Superintendent Michael Chitwood said the 36-year-old driver of the Honda civic suffered severe long-term injuries, including fractures to her femur, collarbone and sternum, and injuries to her head. Although police noticed a baby seat in the back of the woman’s car, luckily her children were safe at home. The driver of the van injured his hand.

Chitwood said it was a “miracle” that the victim survived, and that had the children been in the car they would have died.
